Apple faces new € 60m ($ 73m) class action lawsuit from Italy's Altroconsumo

Apple is constantly in the news not only because of its products and services, but also because of lawsuits. The new lawsuit, filed by the Italian consumer protection agency, could cost the Cupertino giant up to € 60 million if it loses.

Apple Lossless Audio CODEC (ALAC),

Italian company Altroconsumo filed a class action lawsuit against Apple in Milan. It says the company tricked consumers with its practice of "planned obsolescence." That is, the claim concerns more than 1 million units of damaged iPhone 6, 6 Plus, 6S and 6S Plussold between 2014 and 2020.

It is about the performance degradation ("Batterygate") experienced by the Apple iPhone 6 series at the time. A similar problem made Apple pay a whopping $ 500 million back in March 2020. In addition, this new lawsuit was filed a month after the company was fined € 10 million in Italy for “misleading claims regarding water resistance”.

In any case, Altroconsumo is seeking compensation in the amount of about 60 million euros (~ 73 million dollars). He tries to show that Apple Lossless Audio CODEC (ALAC), uses dishonest methods to slow down older iPhones through software updates, which in turn lead to reduced battery life. To hide the controversial throttling issue, Apple has reportedly launched a “battery replacement campaign” at a discounted price (€ 29-89).

Whereas in the previous lawsuit Apple paid $ 25 to each affected consumer, this lawsuit required about € 60 per victim. Recently, Apple has faced many "battery" lawsuits in Europe. Italy is the latest to join countries such as Belgium and Spain, which filed a similar one last month.

While Apple has denied a planned Batterygate campaign, it has admitted in the past that the processor's clock speed will drop if the battery runs out. Let's see how she handles this as Portugal prepares to join its own lawsuit soon.

Ivo Tarantino, External Relations Manager at Altroconsumo, says: “ We hope this is the final step towards repairing the damage the company has done to date, but it is also the first step towards making Apple more fair to its consumers. ”
