Apple terminates lawsuit against Prepear over its pear-shaped logo

Despite the Prepear logo being a pear, Apple still claimed that it was very similar to its own logo. Prepear founder Natalie Monson has accused Apple of crushing small businesses that may not have the financial capacity to fight the tech giant in extended lawsuits. She insisted that their pear-shaped logo in no way resembles the Apple logo and therefore could not harm the Apple brand. Thus, the company is fighting thousands of dollars in bills to support its defense in the lawsuit.

According to court documents filed by Apple, it tried to rationalize how the pear logo might look like the Apple logo, as the Prepear pear was designed in a way that clearly mimics the world famous Apple logo and could give Prepear an unfair commercial advantage. The petition, drawn up by Super Healthy Kids, the parent company of Prepear, has already garnered over 250 signatures, and the tech giant may have noticed possible backlash if it insists on continuing. And now it seems like Apple might be giving in, and that might be exactly what is happening.

Documents filed with the U.S. Patent and Trademark Office's Judicial and Appeals Board show that Apple and Prepear's proceedings should be postponed for 30 days as both sides try to resolve the dispute out of court. If a settlement is not reached by January 23, 2021, the proceedings will continue on that date. In addition, either party may choose not to wait until that date and reopen the proceedings at any time.
